Wesley Mission is a Parish Mission of the Uniting Church in Australia comprising 10 related congregations of the Church which appoint representatives to a Mission Council. The administration of the Mission is subject to the provisions of the Uniting Church in Australia Act 1977, and to the Constitution, Regulations and By-Laws of the Uniting Church in the same manner as any other congregation or group of related congregations.

Wesley Mission itself has no legal status. It can best be described as a part of The Uniting Church in Australia Property Trust (NSW) ("the Property Trust") which is a body constituted by the Uniting Church in Australia Act. The Mission is therefore part of a Statutory Corporation.

At Law, all property finances offerings government and corporate funding and donations held or provided or granted to any congregation or person for the purposes of the Church are deemed to be vested in the Property Trust. The Property Trust is required to hold all this property finances and donations, etc, for the purposes of the Church which are defined in the Constitution. Congregations, related congregations and agencies of the Church have the benefit of use of Church property and finances for the purposes of the Church. Under Regulation 4.4.1 the Church Council (Mission Council) is responsible for the management and administration of this property and finance.

The Mission Council has delegated its powers of management and administration to the Wesley Mission Board and to the Wesley Mission Management Committee.

The Members of the Wesley Mission Board and the Wesley Mission Management Committee are listed in the attached annexure together with profiles for each member including his or her qualifications and experience.

In accordance with the Regulations all decisions and transactions relating to the use of the property and finances of the Mission (with the exception of day to day management transactions) must be approved by Sydney Presbytery and the Synod of the Uniting Church in the manner required by the Regulations.

Tax Concession and DGR Status

Wesley Mission does not have a separate legal status. It does have a separate Australian Business Number (ABN) - 5799 6964406 and under this ABN is endorsed as a “Tax Concession Charity” and also as a Deductible Gift Recipient under the Income Tax Assessment Act 1997. Under subdivision 30-B of the Act the Mission is endorsed under "Item 4.1.1 - Public Benevolent Institution".

This Tax concession and DGR Status extends to every activity of Wesley Mission - even to its commercial or non-charitable/benevolent activities, provided however that such activities can always be demonstrated as being integral to the dominant public benevolent purposes of the Mission.

With respect to the NSW Legislation relating to charities (the Charitable Fundraising Act 1991), it has not been necessary for the Mission to make application to become a registered charity. Under Section 7 of the Act all "religious organisations" are exempt.

The Employer

For the purposes of workers compensation and other employment related issues, the Employer is deemed to be Wesley Mission (Under this legislation the Employer does not have to be a legal entity - it is only necessary to establish that the organization has a Management Committee). For litigation not related to workers compensation or employment termination the appropriate party should be the Property Trust (for example, harassment or discrimination).
